As we would like you to have full confidence in the content of our site being the reference in terms of online product consultation and management, we want to provide you complete and clear information about our platform.
Article 1 - Purpose and acceptance
As mentioned above, these Terms and Conditions of Use are established so that each user can take into consideration the terms and conditions determined by the site and applications. By the present, any User declares to have understood the terms of the General Conditions of Use of Dpp-portal.eu and Dpp-pocket and to have accepted them without reserve or modification of any kind. However, by continuing their navigation on the Site, the User is contractually bound to these Terms and Conditions of Use which are therefore fully enforceable.
Specific terms
User: any physical person, acting in a non-professional capacity, having access to the Dpp-portal.eu site or Dpp-pocket app and consulting the referenced Products.
Reseller: any commercial site whose available for-sale products are referenced on the Dpp-portal.eu site or Dpp-pocket apps.
MARAJY-TECH: company that publishes and operates the Dpp-portal.eu site and Dpp-pocket app, specializing in the business sector of computer systems and software consulting, registered with the RCS under the number Versailles B 885 305 789, located in HOUILLES (78800), FRANCE.
Referenced Products: the products referenced on the Dpp-portal.eu site and Dpp-pocket apps.
DPP Services: any service made available to Users, Manufacturers or Partners on DPP Services, Dpp-portal.eu site or on Dpp-pocket apps.
Article 2 - DPP Services
2.1. Description of services
DPP Services provides a platform that gathers product information. The centralized system helps consumers search for the products that best meet their needs via a streamlined website with a well-planned information architecture.
DPP Services helps manufacturers document and publish a wide range of information about their products. These data are made available to professionals and consumers through APIs and a well-designed user interface that facilitates the management of product information.
DPP Services uses documented, comprehensive and easy-to-use APIs that are suitable for all types of businesses looking for product information. We have designed an ultra simple and fast web application to provide you with the best way to efficiently consult product data.
2.2. Product search service
The search service via Dpp-portal.eu is free and does not require any registration. It is a search service classified by category and/or keyword among the offers of the Merchants in order to consult the referenced Products and the Digital Product Passport.
Dpp-portal.eu and Dpp-pocket provide the User with a redirection link to other websites, namely the Merchant's website. Thus, if the User wishes to purchase one of the Referenced Products, they will have to go to the Merchant's site to complete the purchase.
Article 3 - Responsibilities and guarantees
3.1. Accuracy and Updates
DPP Services strives for accuracy in the information provided on the Website Dpp-portal.eu and Dpp-pocket and for automated daily updates. However, errors not depending on our will may occur and the following rules apply under these Terms.
Any User must take into account that the information provided on the Website is exactly what was communicated by the Sellers or from the websites of the Sellers. Thus, DPP Services cannot guarantee either the reliability or the exactitude of the information relayed. The same applies to results coming from data processed in an automated way.
No guarantee not expressly given in these Terms may be derived from search results, advice or information obtained through DPP Services. In the event of a discrepancy between the information displayed on DPP Services and that displayed on the Seller's site, the Seller's information shall prevail.
Prices displayed on the DPP Services platform do not include any shipping charges, warranties, or other charges invoiced by the Seller such as delivery charges, VAT, etc. Additional fees may apply beyond the price displayed on DPP Services.
The actions undertaken by the User are exclusively binding on the User. DPP Services cannot, in any case, be held responsible for actions undertaken on the basis of information concerning a referenced Product and the related expenses. Consequently, the DPP Services website is exempt from any responsibility for losses or damages resulting from actions taken with a Seller.
Also, the referenced Products do not constitute an exhaustive list of all offers available on the Internet.
3.2. Relations between the User and the Seller
The relations and transactions between the Seller and the User do not engage DPP Services, which is not a party to the contractual clauses binding the seller and the buyer. When a User makes a purchase of a referenced Product, the User accepts the Terms and Conditions of Use and the Terms and Conditions of Sale of the Seller's website.
The accuracy and updating of important information concerning the conclusion of the contract must be verified by the User prior to concluding the contract or completing a purchase. Liability for any damage related to the purchase, delivery or use of a referenced Product purchased from a Seller cannot be attributed to DPP Services.
3.3. User Contributions and Liability
By accepting these Terms and Conditions, the User is solely responsible for opinions and comments they publish. DPP Services, as a host of opinions published by Users, benefits from liability limitation provisions in accordance with Law No. 2004-575 of June 21, 2004 on confidence in the digital economy. DPP Services does not guarantee the accuracy of Users' opinions.
Each User is responsible for ensuring that their opinions do not contain defamatory, abusive, vulgar, hateful, harassing, obscene, sexual or otherwise illegal content, or content infringing third-party rights (notably intellectual property rights and personality rights).
Users acknowledge that their comments may lead to legal actions against DPP Services, its subcontractors and suppliers by third parties. The User therefore indemnifies those parties against all claims, damages, costs and expenses arising from such comments.
DPP Services may remove or refuse to publish any comment that would be contrary to the law, these Terms, or likely to infringe the rights of third parties.
3.4. Service Access and Security
Each User must have access to the Internet through an access provider of their choice, at their own expense. The User acknowledges that:
- The reliability of transmissions depends on the heterogeneous nature of infrastructures and networks and may be subject to breakdowns or congestion;
- The User is responsible for measures to ensure the security of their equipment, data, and software (notably against viruses and attacks);
- The User is responsible for the equipment used to access DPP Services and MARAJY-TECH cannot be held liable for any direct or indirect damage resulting from a User's connection.
3.5. Limitation of Liability and Service Interruptions
To optimize the operation of the DPP Services platform, MARAJY-TECH undertakes to use all necessary means. However, MARAJY-TECH declines any commitment in the following cases:
- Modifications, interruptions, breakdowns and malfunctions of communication supports of any origin;
- Temporary non-access to DPP Services caused by technical problems;
- Any direct or indirect damage resulting from access, management, use, operation, malfunction and/or interruption of the DPP Services platform;
- Illicit exploitation or abnormal use of the DPP Services site by the User;
- Problems concerning Internet access, hacking, computer attacks, deprivation, suppression or prohibition, temporary or permanent.
Regarding direct damage caused to a User as a result of a breach of contractual responsibilities as defined herein, MARAJY-TECH's liability cannot be engaged except as expressly provided by applicable law.
Article 4 - Intellectual Property
4.1. DPP Services displays product listings, patents, trademarks and logos of Sellers for informational purposes only. Use of intellectual property elements does not imply any association between Sellers and DPP Services.
4.2. Except for Sellers' intellectual property rights, other elements displayed on DPP Services (copyrights, related rights, trademarks, database producer's rights) belong to MARAJY-TECH. These elements may be used by Users free of charge only for normal use of the Service. Users must not alter these elements.
The reproduction, modification, use, publication, representation or extraction of all or part of the elements of DPP Services without prior written authorization from MARAJY-TECH is prohibited and may give rise to legal proceedings.
MARAJY-TECH prohibits Users from reproducing all or part of MARAJY-TECH trademarks and/or logos without prior written authorization.
As a producer of databases, in accordance with the Intellectual Property Code, MARAJY-TECH prohibits any extraction and/or reuse of data from the DPP Services site. MARAJY-TECH reserves the right to prosecute persons who violate these Terms and Conditions.
Links provided by DPP Services to third-party sites are for information purposes only. MARAJY-TECH is not liable for the content or use of those third-party sites.
Article 5 - Modification of the DPP Services platform
5.1. MARAJY-TECH may modify or interrupt access to all or part of the DPP Services platform and/or the website at any time.
5.2. MARAJY-TECH may modify all or part of these Terms of Use at any time. Users are invited to consult these Terms regularly to be aware of any changes.
Article 6 - Other
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be deemed not written without affecting the validity of the remaining provisions. These Terms are governed by French law.
